Terms of Service

1. Agreement to Terms

By accessing or using NetPitch ("Service"), operated by HourSchool LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including parents, guardians, and student-athletes who access the Service.

2. Description of Service

NetPitch is a college recruiting tool that provides:

• Access to college coach contact databases
• Email composition and personalization tools
• Outreach tracking and follow-up management
• Recruiting organization features

The Service is designed to help families streamline the college athletic recruiting process. We do not guarantee admission, scholarships, or responses from college coaches.

3. Eligibility and Account Registration

Age Requirements

• You must be at least 18 years old to create an account or sign up for early access
• The Service is intended for parents/guardians of student-athletes
• By signing up, you represent that you are the parent or legal guardian of any student-athlete whose information you provide

Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information during registration
• You must promptly update your information if it changes
• You must notify us immediately of any unauthorized use of your account

4. Pricing, Subscriptions, and Payments

Subscription Plans

NetPitch offers the following plans:

• Monthly: $24.99 per month, billed monthly
• Annual: $149 per year, billed annually
• Lifetime: $379 one-time payment for lifetime access

Prices are in US dollars and do not include applicable taxes. We reserve the right to change pricing with 30 days' notice to active subscribers.

Automatic Renewal

Cancellation

• You may cancel your subscription at any time by emailing netpitch@hourschool.io or through your account settings
• Cancellation takes effect at the end of your current billing period — you will retain access until then
• No partial refunds are provided for unused portions of a billing period
• After cancellation, your account data will be retained for 90 days in case you wish to resubscribe, then deleted upon request

Refund Policy

• If you are unsatisfied with the Service, you may request a full refund within 14 days of your initial purchase or any renewal charge
• Refund requests should be sent to netpitch@hourschool.io
• Refunds are processed within 10 business days to your original payment method
• Lifetime plan purchases are refundable within 30 days of purchase

Payment Processing

Payments are processed securely through Stripe. We do not store your credit card information on our servers. By providing payment information, you represent that you are authorized to use the payment method. For questions about charges, contact netpitch@hourschool.io.

Early Access Signups

If you signed up for early access before launch, you may have received a discount code. Discount codes are subject to their stated terms and expiration dates.

5. Acceptable Use

You Agree To:

• Use the Service only for legitimate college recruiting purposes
• Provide accurate information about yourself and your student-athlete
• Respect the privacy and time of college coaches
• Comply with all applicable laws and regulations
• Use any coach contact information responsibly and professionally

You Agree NOT To:

• Use the Service for any unlawful purpose
• Send spam, harassing, or inappropriate communications to coaches
• Scrape, copy, or redistribute any coach database
• Share your account credentials with others
• Attempt to gain unauthorized access to the Service or its systems
• Use automated tools to access the Service without permission
• Misrepresent your identity or your relationship to a student-athlete
• Use the Service on behalf of others without their consent
• Resell or commercially exploit the Service or its content

6. Intellectual Property

Our Property

• The Service, including its design, features, content, and coach database, is owned by HourSchool LLC
• Our trademarks, logos, and brand elements may not be used without permission
• The compilation and organization of coach data represents significant effort and is proprietary

Your Content

• You retain ownership of content you create (emails, notes, etc.)
• By using the Service, you grant us a limited license to store and display your content as necessary to provide the Service
• We do not claim ownership of your personal information or communications

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Accuracy

• Coach contact information is gathered from publicly available sources and updated regularly
• We make reasonable efforts to maintain accurate data but do not guarantee accuracy
• Coaching staff changes frequently; some information may be outdated
• You are responsible for verifying contact information before sending communications

Data You Provide

• You represent that you have the right to provide any information you submit
• For student-athlete information, you represent that you have parental/guardian authority to provide such information

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF DATA
• UNINTERRUPTED OR ERROR-FREE SERVICE

WE DO NOT WARRANT THAT:

• The Service will meet your specific requirements
• The Service will be available at all times
• Coach contact information will be accurate or current
• Your communications will receive responses from coaches
• Use of the Service will result in athletic scholarships or admissions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT MADE ANY PAYMENTS
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless HourSchool LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or communications you send through the Service
• Your misrepresentation of your relationship to a student-athlete

11. Termination

By You

• You may cancel your subscription at any time (see Section 4 for cancellation details)
• You may request deletion of your account and data by contacting netpitch@hourschool.io

By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your payment method is declined and not updated within 7 days
• We discontinue the Service (with minimum 60 days' notice)

Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days, after which it will be permanently deleted unless you request earlier deletion. If we terminate the Service entirely, active subscribers will receive a pro-rated refund for any unused prepaid period.

12. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to contact us at netpitch@hourschool.io and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, you and HourSchool LLC agree to resolve any claims through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis, in Wayne County, Michigan (or remotely by mutual agreement). The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.

Exception: Either party may bring claims in small claims court in Wayne County, Michigan, if the claim qualifies.

Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

Class Action Waiver

YOU AND HOURSCHOOL LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

12A. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, internet outages, third-party service provider failures, government actions, or pandemics.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on the Service
• Updating the "Last Updated" date
• Sending email notification for significant changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

14. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and HourSchool LLC regarding the Service.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

Notices

We may send notices to the email address you provide. You are responsible for keeping your email address current.

15. NCAA Disclaimer

NetPitch is an independent tool that helps families manage the college recruiting outreach process. NetPitch is not an agent, representative, recruiter, or recruiting service acting on behalf of any student-athlete. NetPitch does not contact coaches on behalf of athletes — all outreach is initiated and sent by the parent/guardian or student-athlete.

Families are responsible for understanding and complying with all applicable NCAA, NAIA, and NJCAA rules regarding recruiting contact. NetPitch makes no representations about the permissibility of any specific communication under athletic association rules.
